Binding arbitration. If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, conducted in English.
Class action waiver. Any arbitration or proceeding shall be conducted solely on an individual basis. You waive any right to bring or participate in a class action or representative proceeding.
Exceptions. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent imminent harm. Nothing in this section prevents you from filing a complaint with a federal or state regulatory agency.
15. Termination
PC Driver Guide reserves the right to restrict, suspend, or terminate your access to the Service at its sole discretion, at any time and without prior notice, for conduct that it reasonably believes violates these Terms or applicable law. Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution — will remain in effect after any termination.
16. Severability and entire agreement
If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary, or severed, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy and other legal notices, constitute the entire agreement between you and PC Driver Guide regarding your use of the Service.
